The Southern African region is experiencing rapid processes of privatization of customary land. While land-based investments by multinational corporates have exacerbated tenure insecurity among the rural poor – and especially among women – they are not the only important process affecting land rights. A combination of less visible local processes is at play in reconfiguring land rights, land uses, and livelihoods. Most national land reforms allow for surveying of boundaries, registration and documentation, leasing, transfers, and selling of customary land. Civil society and international donor agencies have introduced flanking mechanisms, advocating for the registration of customary land rights as a way to protect rural women and the vulnerable. By helping to register land rights they might protect vulnerable women with insecure, yet such an approach can make customary tenure more ‘legible’ to the state, to investors, to other authorities, more transactable, and thereby create conditions the loss of community land. How is the formalisation of customary land rights, as a defense against land grabbing – affecting tenure in the commons? This paper synthesises field research and analysis from work in Mozambique, South Africa, Zambia, and Zimbabwe. We present field-based evidence of the ways in which both national laws and global guidelines variously promote, facilitate, or constrain the formalisation and privatisation of land, and show how this impacts on rural women. The research was implemented by PLAAS in partnership with several civil society organisations in these countries, using action research methods.
La région de l’Afrique australe connaît des processus rapides de privatisation des terres coutumières. Si les investissements fonciers des multinationales ont exacerbé l’insécurité foncière parmi les pauvres des zones rurales – et en particulier chez les femmes – ils ne sont pas le seul processus important affectant les droits fonciers. Une combinaison de processus locaux moins visibles est en jeu dans la reconfiguration des droits fonciers, des utilisations des terres et des moyens de subsistance. La plupart des réformes foncières nationales permettent d’arpenter les frontières, d’enregistrer et de documenter, de louer, de transférer et de vendre des terres coutumières. La société civile et les organismes donateurs internationaux ont introduit des mécanismes d’accompagnement, plaidant pour l’enregistrement des droits fonciers coutumiers comme moyen de protéger les femmes rurales et les personnes vulnérables. En aidant à enregistrer les droits fonciers, elles pourraient protéger les femmes vulnérables en situation d’insécurité, mais une telle approche peut rendre le régime foncier coutumier plus ‘lisible’ pour l’État, pour les investisseurs, pour d’autres autorités, plus transférable, et créer ainsi des conditions de perte de terres communautaires. Comment la formalisation des droits fonciers coutumiers, comme défense contre l’accaparement des terres – affecte-t-elle le régime foncier dans les biens communs? Cet article synthétise la recherche et l’analyse sur le terrain de travaux au Mozambique, en Afrique du Sud, en Zambie et au Zimbabwe. Nous présentons des preuves sur le terrain de la manière dont les lois nationales et les directives mondiales promeuvent, facilitent ou entravent la formalisation et la privatisation des terres, et montrent comment cela a un impact sur les femmes rurales. La recherche a été mise en œuvre par PLAAS en partenariat avec plusieurs organisations de la société civile dans ces pays, en utilisant des méthodes de recherche-action.

Ruth, I enjoyed your presentation as usual. Your concluding point that we are seeing an irreversible process of new neo-liberalization of customary tenure is important. How can we then ensure that formalization of land addresses gender concerns, which tend to be grounded on norms, which evolve over a long period and can not be switched off with the passing of legislation?
Ruth thank you for the presentation. Captivating reflection on how the evolving space towards formalization of customary land tenure then implicates on the land tenure rights of women. The need to interrogate the process and emerging dynamics in relation to women land rights as provisioned under customary law and how the formalization of these influences access to and use of land as commons by women.
